    The Gaming Industry has brought more then 17 billion dollars in the year. OF 2007 alone, You can only imagine what 2008 holds and what will 2009 bring. And here we are talking about a kid that will do a few thousand. It is not the drug business morons. The investigation and bust must of cost more money than what this kid would take.     If this guy isn't prosecuted, then that will prove to the community of hacker/crackers/modders, that they can and will be able to get by with their illegal activities with very little consequence, therefore the makers of games won't have any money to make games and the economy of gaming will crumble very rapidly.
    Finally, this will spread to other games as well... and to other software, leading to the destabilization of the economy.
    The meaning of money is becoming warped in these times... Get a job, buy the game. It's only $70.

    I agree with you completely, but $70 is a lot, especially during this down time. It took me several visits to GameStop to be able to pay off my pre-order of the game. So I don't think it's appropriate to say that it's "only" $70.

    But all in all, the kid needs a spanking.

    I agree with Ninnesota's statement as well, I shouldn't have said "only" $70... Though I can't say much more, because the price will only go down if NO ONE BUYS THE GAME for the first (at least) two weeks... but seriously, that is definitely NOT going to happen. 100% sure of that.
    So, everyone's lesson: use the Golden Rule which is (in my opinion), do to other as you would have them do to you... and in the mean time don't commit to making an illegal business/operation via the "super-secure" internet (including Kijiji, eBay, a site that you own/made, etc).

    If you can't afford to pay $70 for a game, then maybe wait a few month until the price is going down? And they will, check Amazon for games that have been out a while - NONE sells for the initial amount.

    Also, have you heard about game companies laying off people, closing studios etc. in the last two years? Yup, despite the fact that they "make BANKS look poor".

    Oh, and ask yourself: why not go into a store and steal a game if $70 is too expensive? That's something different? Nope, it isn't.

    Wow! You really need to study the industry a little bit better...better yet, take some business classes. First off, developers get maybe 5-10% of the cost of the game. So that is roughly $6 or under. Taxes go to the government so you can't consider that in the cost. Out of a $59.99 game, a portion goes to packaging (DVD, case, box art), a portion goes to the distributors that send thousands of copies to GameStop, BestBuy, Walmart, etc, another portion goes to the stores that sell the games, and a portion goes to the Publisher. So if you really think these developers are making bank, you're sadly misinformed. Most video game employees don't make very much money. Hardly ever do they break $50k/$60k. In today's economy, you can support yourself on that income, but don't think it's enough for a family.

    1. take a look into the profit margins of game developers like Activision. they charge upwards of $70 for a game that takes maybe $20 to make.vdon't cry for them, these guys make BANKS look poor.

    2. if you actually read the article, it stated that you had to have a modded console to even play the game, meaning they were already deep behind enemy lines before they purchased. and, frankly, they deserve to get banned for playing a game BEFORE THE RELEASE DATE. when you mod the console, you void the warranty AND violate the terms of service of XBL, knowingly.

    But, to the author of this article.. myself and many of us would very much appreciate it if you and the rest of the media would stop portraying hackers in a negative light. This guy is *NOT* a hacker. He is not deserving of that title, nor will he ever be. A hacker is a computer guru, a wiz kid, a programmer, or anyone who's just plain bad-ass with a computer. A CRACKER on the other hand, does damage, breaks into financial systems, pirates software (also known as a "software pirate"), and they are criminals. A Cracker is a hacker who's gone beyond the darkside. True there are "Black-Hat" hackers, ones who disregard the law and do dastardly deeds, but even they are above crackers.

    As long as games are $59 and software companies continue their greed. They deserve to be pirated. You can find games all day long in any other country for $1 in China and $2 in Mexico. We should be able to pre-order a game and have it sent to us via digital delivery and a hard copy mailed to us for backup. Band together and encourage piracy and or boycott video games that charge over $19-$25 per unit. The system is flawed!

Undoubtedly this kid's attorney will play up to the fact that he is only 18 and doesn't know any better, this is likely his first offense, and by the looks of his dad's business he will have some reputable character witnesses to back him up. He'll probably be slapped with some outrageous fines to pay as a result of a lawsuit from Activision, but no criminal or federal charges will be filed against him as that would be horrible publicity for Activision.
    It really is a double-edged sword, yes the kid should be punished, but to what extent? In my opinion the books need to be re-written to deal with digital copyright infringement instead of the DMCA garbage document we have which is HEAVILY based on outdated physical media. This is 2009 and our judiciary system seems to be having trouble keeping up with technology. It really is a shame that IPCyberCrime has made such a huge deal out of this, as I said the kid is a thief and should be punished, but they are plastering him like he got caught hacking into a bank's network and stolen millions of people's credit card information. It's funny that those attacks happen on a daily basis and they are always kept very hush hush. You tell me, would you rather see a kid pirating some video games have this much effort put into taking him down and charging him millions of dollars for damages or would you rather see the effort put into taking down someone who has stolen millions of credit card numbers and potentially much more personal information which could lead to other cyber crimes like identity theft?

They are entitled to make MILLIONS of dollar back, and the point of bening a business is to make money. You always want to make more than what you invest. If everyone hacked their systems and bought games for $1-2, then game developers would go out of business and you'd get stuck with crappy games for such little margin.

    You are right. So right in fact that, in order to make money, companies ultimately make the consumer pay for everything: the advertising, the development costs, the packaging, etc... And if they don't make a profit, they turn around and tell the government: "hey! we lost money this year so we don't have to pay taxes." And funnily enough, the consumer ends up paying (in some twisted way of course) even if he didn't want to buy the thing. And don't tell me it's not happening like that, especially after what happened in the last year with US banks and car companies...

    As to game prices... if it's too high a price, don't pay or wait until it's on sale, becomes a "Greatest Hits" or buy it used. That's the way the "free market" is supposed to work. The revenue generated is divided by the retailer (who has limited shelf-space and needs to make a profit to pay for all of their overhead), there's the cost of goods (not just the disc but packaging, artwork, manual, etc.), there's the royalty that needs to be paid to the platform (Sony/PlayStation, Microsoft/Xbox, etc.), the cost of marketing - TV, internet, promotions, etc. (Sidetrack: ever wonder what happened to all your favorite game mags? Everyone want's it now for free and turned to the internet... I'm not saying its wrong but the cost of expediency meant a loss in the publications we used to love to read) and then there's the scores of folks who work on the game as well as all those that support the business (yes, even their healthcare plans!).

    The revenue that is left over covers cost of development of other games (which may be a hit or may not) as well as the next sequel which needs to be bigger, better, faster and bolder.

    Seems a lot of folks need to pull their head out of their arses and get real. Stealing is wrong. If you can't afford the price, then wait or go find something else to do... like read a book (you can get those from a library for free!).

    Well not everybody knows how complex a good pirater has to think. Most people can't even percieve that it is even possible to make copies of games exactly like the new ones. I modded one of my boxes and it got banned, did that slow me down? NOPE! Bought a red rings messed up one off of craigslist, fixed it, then found a video that shows how to install both disc reading firmwares so it should be 99% failproof but you just cannot play with the modded firmware online. The only reason most people are complaining about one guy is because they are not smart enough to get there own things for free. Sure, I still buy games myself and own about 50 of my own legit copies but the amount I purchase has sure gone down lately because how many games that are available to online gaming are really worth paying 70$ a piece.

    That's an interesting statement. How do you determine the worth of a game? Look back ten, 20 years - gaming has pretty much stayed stable price-wise while absolute costs for everything else (food, housing, cars, gas, movie tickets) has gone up. At the same time, production costs for games have gone up, too.

    Do you play all the games you pirate? Or just a few? Why not buy those, if not on day one, then when they are in the bargain bin a few weeks to months later?

    There was no "code to crack" to copy the disc, unless he meant opening the case to get to the disc. 360 HDs cannot be pre-loaded with games, Xbox 1 ones could.

    Online piracy is considerably more sophisticated than one kid ripping a stolen retail copy and uploading it to a few bit-torrents sites. It's wrong and yes it's illegal, but it's also well organised with a fairly stringent set of rules and the vast majority of groups don't do it for money.

    If you're going to write an article, get it right.

There is no law against modding ones console but I dunno about modding other peoples console. Could be the same hand in hand in either case. Also note that anyone playing any early games on 360 are banned if caught which most douchebag kids thinking that if they play a game early they are cool and have bigger epenors or whatnot. Frankly M$ should keep banning consoles for early players on live on the console itself and/or not just the account. I mean i see many file hosting links for all these piracy software around its astounding. The way to quell piracy imo is to go after places that host large server services. Most of those content are store there. Rapidshare, Megaupload and such to name a few. Heck they even could use Google Mail so this is somewhat a gray area. Don't forget pirates use usenet, torrents. But they all seem to converge on a certain chat program minus forum rants. Anyway the only complaint I have is that anyone profitting from free content should be jailed/charged at the most. Those that only use if for personal benefit (nothing more) should be left alone. But that net neutrility act is already in play to stop try to stop piracy. Frankly that would be in the wrong since it just makes the companies seem like they just want more money where as they spending billions on trying to stop them and in the end not working rather than finding an alternative. Most people say they only buy games they like, if they do then why download and keep games they don't like? I still call it BS but moving on, there are more low income people than there are rich people. So expect many pirates on the bandwagon besides those that actually work and still do it and make more off the side from it? I even know some people that WORK for game industries that pirate themselves... so its not just regular people doing it. You also wonder how leaks tend to happen also being it movies etc. right?     those who are saying that he should get punish for what he did. i totally agree. he should get the max penalty. because of assholes like him, the game industries lose money to develop new games for the future. if these gamers are buying/ selling the stolen version of the game, your not just hurting the companies that develop such great games (halo, bioshock, MW, mass effect etc) but our economy. why are that your poverty levels and the food prices increased? a bag of chips is no long 70 cents or a dollar but $150. why is our single dollar value is much lower now? it's all relevant to situations like this. it's cuz' of assholes who buy/ sell the stolen versions of products. now i'm not just talking about games but also movies, music and etc. it's not fair for the gamers that have patiently waited until the due date of the game. by respectfully waiting until the release date, and buying from a legitimate source, you're saying to the developers that you appreciate their work. it's bad enough for the developers that to make a game cost hundreds of millions of dollars. they also have to pay their team of staff, maintence, publishing, advertisements etc etc.

They need to take down all those other fags charging for free games and such. Modding on the other hand is only the console itself unless they sell the games. There is no law against modding ones console but I dunno about modding other peoples console. Could be the same hand in hand in either case. Also note that anyone playing any early games on 360 are banned if caught which most douchebag kids thinking that if they play a game early they are cool and have bigger epenors or whatnot. Frankly M$ should keep banning consoles for early players on live on the console itself and/or not just the account. I mean i see many file hosting links for all these piracy software around its astounding. The way to quell piracy imo is to go after places that host large server services. Most of those content are store there. Rapidshare, Megaupload and such to name a few. Heck they even could use Google Mail so this is somewhat a gray area. Don't forget pirates use usenet, torrents. But they all seem to converge on a certain chat program minus forum rants. Anyway the only complaint I have is that anyone profitting from free content should be jailed/charged at the most. Those that only use if for personal benefit (nothing more) should be left alone. But that net neutrility act is already in play to stop try to stop piracy. Frankly that would be in the wrong since it just makes the companies seem like they just want more money where as they spending billions on trying to stop them and in the end not working rather than finding an alternative. Most people say they only buy games they like, if they do then why download and keep games they don't like? I still call it BS but moving on, there are more low income people than there are rich people. So expect many pirates on the bandwagon besides those that actually work and still do it and make more off the side from it? I even know some people that WORK for game industries that pirate themselves... so its not just regular people doing it. You also wonder how leaks tend to happen also being it movies etc. right? Even though there are ways to stop piracy, sometimes it screws the legit users though I've never had any trouble by far with any of the anti piracy methods. Though those ones that install stuff secretly in your system or whatnot is something I won't stand for unless notified.
