    This isn't an NDA or non-compete case, this is an ownership case. Assuming the paperwork is in order, under Cal Labor Code Section 2870, if the employee uses work time, employer equipment , supplies, or facilities or if the work relates to the employer's stuff, the employer owns it. In California what you do as an employee does not belong to you. And the company isn't entitled to a portion of it -- the employee is entitled to none of it.

    That completely sucks. I can't believe that some company thinks they're entitled to what a developer built in his spare time, using no company resources (assuming that's the case, of course). Fuck being owned by some piece of shit corporate machine.

    I feel like I read somewhere that these types of agreements are usually not enforceable in California, but Freewebs looks like they're headquartered in Maryland (though SGN is in CA), so it might depend on where he was working when this occurred. Regardless, it sounds like bullshit. Hope he fights and wins.

    I'd love to see you on the other side one day. When you become your own CEO and you start your own company and then when you hire an employee and you pay him out of the savings you have and you find out he left and took your ideas and started his own thing.

    Ouch that going to hurt. There was a thread on YComb few days ago about a similar topic. As a new employee, what sort of agreement is agreeable and what's not.

    If it were google or yahoo, they'll probably just close one eye but its such shady, sneaky startups that don't have any solid stuff going for them that you as an employee would want to be careful off. Make sure you do not sign your life away.

    What you do out of your work hours should be your own fucking business.

    If an employee uses company time and/or company resources including "trade secrets" for their own profit, then the company is entitled to a portion of it. For the most part, cases like these rarely make the courts in California. The violation has to be quite blatant, but I have heard of one example of an entire (IBM?) department disappearing seemingly overnight only to resurface as a different company somewhere else (people+hardware).

    The rule of thumb is that unless there's a lot of money at stake, nobody bothers. Obviously, a million a month for Freewebs is a big deal. For Google it would be lunch money.

    By someone who worked in a separate part of the company.
    On personal time and on personal equipment.

    I wonder how it works here in the UK. I'd hate to think that I couldn't come up with an idea, in my own time, develop it at home and then start releasing it, all during my free time, without having to quit my job first to make sure they don't claim it!

    I don't think anyone has given this much thought. This is not the company SGN or the guy David Maestri. Their deal will work it's self out. If David signed a contract and took anything from the company then he should lose and if SGN is just being money hungry then they will get what they deserve, nothing. The real problems are the FUCKING LAWYERS who bring these contentious lawsuits before a cowardly judge who allows this kind of crap. Lets be honest for a moment, If all of the lawyers and judges in the United States were killed would anyone give a shit? No, no loss there. We need to get rid of a bunch of these assholes because they are the world’s biggest problem. They have gotten corrupt over the last century and we sit back and watch these money grabbing crooks screw the system. What in the fuck do you think is going to happen when some dick head judge/lawyer who allows a billion dollar lawsuit over a car defect or a tire failure, how about some moron who chooses to smoke and gets cancer? This may all be tragic, but none of this is worth millions let alone billions. Who do you think pays these giant ass rewards? We do the poor tax payers takes care of the bills as always. This kind of crap has to stop. We allow this kind of shit to go on and them bitch when it does not go our way. If we killed about half the fucking lawyers and threatened the rest, no kill them all and start over. That is the only way it will ever work out again. Judges are a bunch of assholes who are to afraid to stick their neck out and make a decision. Few of these people have any honor, they have no clue what the word means. They prey on anyone who can pay the price to screw with one another and they all will take on these kind of lawsuits regardless whether it is true or not. We need to take back our courts and stop the contentious lawsuits. While I think our courts are important we need to get some set of rules to run the fucking ambulance chasing assholes out of the courtrooms and get the chickenshit judges off of the bench. GRRRRR, this kind of shit just goes to prove that many of the companies try to get a piece of all their employees minds just in case after they leave they can get a chuck of the pie these people may come up with in the future. What a bunch of crap. Again, fucking lawyers, who on earth would every come up with something so contentious and cowardly but a lawyer? LOL

    That being said, I don't know if David Stole from (Freewebs) spin off SGN, but it will all come out in court, if he was dumb enough not to see Mob Wars full potential and didnt quit before just to cover his ass, then something is off, for an obvious tech savvy entrepreneur to not know better, shows someone want his cake and eat it to, plus a safety net, well go big or go home, or in this case Go Big or lose your effin home cause you a thief and if not just dumb and greedy, eitherway something shady is going on, cause if there was no grounds for a lawsuit it wont make through court and or even get to a trial, besides making all that money if the figures are tru, what has he done for his users??? the faithfuls???

    Zuckerberg's Harvard classmates, Divya Narendra, Cameron Winklevoss, and Tyler Winklevoss, claim they hired him to finish the code on their website, ConnectU and that he stole their idea, design, business plan, and source code. A lawsuit was filed in 2004 claiming a breach of contract, misappropriation of trade secrets, copyright infringement, in addition to other claims. Zuckerberg claims there was no contract and that he was not a partner. They are seeking monetary damages.[11] ConnectU has maintained that it is not their intention to shut down Facebook.

    Since its original filing in Massachusetts, the lawsuit was dismissed without prejudice on March 28, 2007, but was never ruled on. It was refiled soon thereafter in U.S. District Court in Boston, and a preliminary hearing was scheduled for July 25, 2007.[12] At the hearing the judge told ConnectU that parts of their complaint were not sufficiently pled and gave them the ability to refile an amended complaint.

    On 25 June 2008 Facebook agreed to pay an undisclosed amount of cash and stock to settle the legal battle with ConnectU. The terms of the deal were confidential and the Winklevosses, Narendra and ConnectU agreed to make no future claims.

    Dave was actually working at Freewebs when he made this, which is located in Silver Spring, MD, and under our law, if he made it on company time, using our computers and equipment, we have every right to sue the pants off him. It's unfortunate, but its how it works. Had he went home and created Mobwars on his down time, it would have been a different story and the money would have soley been his. The fact that he later went over to SGN in California doesn't change the fact that the game was created and finished here in Maryland at Freewebs.

    No, the REAL problem at hand here is that a.) these types of agreements are allowed anywhere outside of using company property, time or secrets. b.) (most of all) that it's not so much of a will he win scenario, it's litigation that is counting on whether or not the judge is a complete idiot such as in cases involving anything technical where judges just don't have a clue. It generally amounts to the judge having as much clue about about what is going on and having as little business being the judge in the case, as a white supremest redneck in an NAACP board meeting.
